What is an FFL Transfer?

With the recent surge in online firearm purchases, understanding how to conduct a firearm transfer has become more important than ever. If you plan to send or receive a firearm across state lines, you'll need to complete the transfer through a licensed FFL (Federal Firearms License) dealer. This process is commonly referred to as an“FFL transfer.”

However, it's not as straightforward as it may seem. There are numerous potential pitfalls if the process isn’t handled correctly. That's why it’s crucial to fully understand all the nuances of an FFL transfer and how to do it right.

FFL Transfer Definition

An FFL transfer refers to the process of transferring a firearm from a Federal Firearm Licensee (FFL) to another FFL holder or a customer. Under federal law, specifically the Gun Control Act, an FFL transfer is required whenever a firearm is purchased from an FFL or shipped across state lines to another person.

For example, when a gun shop (an FFL dealer) ships a firearm to another FFL holder (whether it’s another shop or a home-based FFL), the firearm is considered “transferred” from one FFL to another. Similarly, when the second FFL sells the firearm to a customer, the gun is “transferred” from the FFL to the buyer.

The term “FFL transfer” is used because of the specific ATF (Bureau of Alcohol, Tobacco, Firearms, and Explosives) requirements involved. Firearms must be logged in and out of the FFL’s Acquisition and Disposition (A&D) Book in a prescribed manner, and certain paperwork must be completed before the firearm leaves the licensed FFL dealer’s location.

When transferring a firearm to a customer, additional steps must be taken, including meeting federal background check requirements, completing ATF Form 4473 (a transfer form filled out by the customer), and following other regulations required for the transfer.

In short, when you hear the term “FFL transfer,” it refers to the processes that must be completed to legally transfer a firearm from an FFL, usually a gun shop, to another FFL or customer.
